These Terms of Service ("Terms") apply to your use of madamme.co (the "Site") and to every purchase made from MADAMME ("MADAMME", "we", "us"). By using the Site or placing an order you agree to these Terms, together with our Shipping & Delivery Policy, Returns & Refunds Policy and Privacy Policy. If you do not agree, please do not use the Site.
1. ELIGIBILITY
You must be at least 18 years old, or the age of majority where you live, to use the Site and place an order. Some products, including personal pleasure products, are intended for adults only.
2. PRODUCTS & IMAGES
We make every effort to show our products accurately. Colours, textures and fit may look slightly different depending on your screen and lighting. Some images on the Site, including campaign and editorial images, are styled or digitally created to show the mood of a collection; product details, sizes and what is included are described on each product page.
3. PRICES & CURRENCY
Prices are shown in your local currency where available and may change at any time without notice. The price that applies is the price shown at checkout when you place your order. Where a product shows a crossed-out reference price, the reduced price is the price you pay.
If a product is listed at an obviously incorrect price because of a technical or typographical error, we may cancel the order and refund any amount paid, even after confirmation.
4. ORDERS & ACCEPTANCE
Your order is an offer to buy. The contract is formed when we dispatch your order and send the shipping confirmation. We may refuse or cancel any order, for example where a product is unavailable, an error is found, or we suspect fraud or misuse. If we cancel an order you have paid for, we refund the amount paid.
5. PAYMENT
Payments are processed securely by Shopify Payments and its partners, including Shop Pay, Apple Pay, Google Pay and major cards. We do not store your full card details. You confirm that you are authorised to use the payment method you provide.
6. TAXES & DUTIES
Where applicable taxes or import duties are collected at checkout, this is shown during checkout. Otherwise, import charges set by the destination country may be payable by the recipient, as described in our Shipping & Delivery Policy.
7. SHIPPING, RETURNS & REFUNDS
Delivery is governed by our Shipping & Delivery Policy. Returns, refunds and store credit are governed by our Returns & Refunds Policy, including the hygiene conditions that apply to lingerie and intimate products.
8. DISCOUNT CODES & PROMOTIONS
Discount codes and promotions are subject to the conditions stated with them, cannot be exchanged for cash, cannot be combined unless stated, and may be withdrawn at any time. We may cancel orders that use codes obtained or applied improperly.
9. STORE CREDIT
Store credit issued by MADAMME can be used on madamme.co, is not redeemable for cash except where required by law and cannot be transferred.
10. ACCOUNTS
If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please tell us immediately of any unauthorised use.
11. ACCEPTABLE USE
You agree not to use the Site for any unlawful purpose, to interfere with its security or operation, to copy or scrape its content, to place fraudulent orders, or to resell products bought from us on a commercial scale without our written consent.
12. INTELLECTUAL PROPERTY
All content on the Site, including the MADAMME name and logo, images, videos, text and design, belongs to MADAMME or its licensors and is protected by intellectual property laws. You may not use it without our prior written permission.
13. REVIEWS & CONTENT YOU SUBMIT
If you submit reviews, photos or other content, you confirm that it is genuine and your own, and you grant MADAMME a non-exclusive, royalty-free licence to use it in connection with the Site and our marketing. We may remove content that is unlawful, offensive or misleading.
14. THIRD-PARTY LINKS & SERVICES
The Site may link to or use third-party services. We are not responsible for their content or practices.
15. LIMITATION OF LIABILITY
To the extent permitted by law, MADAMME is not liable for indirect or consequential losses, and our total liability for any order is limited to the amount you paid for it. Nothing in these Terms limits liability that cannot be limited by law, including your statutory consumer rights.
16. CONSUMER RIGHTS
Nothing in these Terms affects the mandatory rights you have as a consumer under the law of the country where you live, including statutory withdrawal, cancellation and guarantee rights in the EU, the UK, Australia and New Zealand.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time. The version published on the Site at the time of your order applies to that order.
18. GOVERNING LAW & DISPUTES
These Terms are governed by applicable law. If you are a consumer, you also benefit from the mandatory protections of the country where you live, and you may bring proceedings in your local courts.
